Some disturbing details have emerged at the recent Fairfield Bay City Council meeting.

It was revealed that a potential lawsuit against the city of Fairfield Bay was threatened by an out-of-state law firm alleging discriminatory pricing at the Fairfield Bay campground. The campground allegedly charged residents differently than non-residents for passes into the campground, which was argued to be unconstitutional and in violation of federal law. 

Legal Issues Revealed At Fairfield Bay City Council Meeting

City Councilwoman Ruth Krotz requested that discussions should be tabled until the matter could be examined to avoid legal issues that could cost the city more money:

“Essentially, they are alleging the campground is using a discriminatory fee structure for their annual passes in violation of federal statutes.”

According to the letter sent to the city council by Bailey Law Firm as related by the councilwoman:

“Their position is, number one, that the annual pass needs to be adjusted to the same for residents and non residents. And that the campground refund any non-resident that paid a higher fee this past year. Or they will be happy to litigate the matter and let the judge decide.”

According to Councilwoman Krotz, the city of Fairfield Bay cannot afford any more lawsuits:

“We cannot afford to go back to court.”

It was requested that the campground issue be tabled and postponed until after November.

Although the city council decided not to table the discussion, it did adjourn the meeting as the campground issue takes more of the city’s time.

The mayor has called countless emergency “special meetings” to push through a city council vote on the campground despite the fact that the campground lease expires on December 31st.

A previous city budget meeting lasted a whopping 5 hours as the Mayor repeated her plan to push for a campground lease.
